US Judge Orders Freedom of Abrego Garcia from Immigration Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.
The case stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face alien smuggling allegations, he was detained in immigration custody.
In her decision, the judge noted that the government does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this time."
Context of the Legal Challenge
The legal challenge center on disputed claims. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this allegation.
He has also pleaded not guilty to the smuggling counts, which are part of a ongoing criminal case in Tennessee.
Terms of Release
The judge, who was overseeing his challenge to deportation in a federal court, ruled that he must now comply with the terms of his release from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
This ruling marks a notable development in a complex legal case involving allegations of mistaken imprisonment and disputed gang associations.
